Standard Operating Procedure during Search
The manual also contains a separate section, which prescribes basic do’s and don’ts to be followed during any search operation. While this part deals with the basics such as whether to switch on a device or not, how to collect evidence, what forms to carry, etc.
With a view to streamline and harmonize all actions carried out by officers of CBIC, Standard Operating Procedures (SoPs) to be followed at the search premises have been attempted and explained in detail in the Manual. Specifically, four scenarios have been identified, to be prepared for, while on Search operations –
(i) System ON; Search team is technically qualified to handle Digital Evidence
(ii) System ON; Search team is NOT technically qualified to handle Digital Evidence
(iii)System OFF; Search team is technically qualified to handle Digital Evidence
(iv)System OFF; Search team is NOT technically qualified to handle Digital Evidence
These four scenarios are expected to adequately cover all scenarios likely to occur, whenever officers embark on a search operation. The Manual diligently explains various precautions to be taken and procedures to be adopted for each of the 4 scenarios mentioned above.
The Manual also prescribes a first responder toolkit, which is recommended to be made a part of every search operation. This toolkit contains essential items/equipment that would be of immense use during every operation such as the various forms to carry, forensics tools, packing material, camera, etc.
