95 Smuggling in India Report 2024-25

            Overview

The rapid expansion of global trade has amplified the challenges posed by coun-
terfeit goods, hazardous substances, and substandard products infiltrating legiti-
mate supply chains. In this evolving landscape, DRI remains resolute as a critical
line of defense, meticulously scrutinizing imports, enforcing stringent regulatory
compliance, and fostering collaboration with allied agencies. These measures not
only safeguard consumer interest and bolster legitimate commerce but also rein-
force the pillars of national security and public health.

-Article 41, WTO Trade-Related Aspects of Intellectual Property Rights Agreement, 1995

As a signatory to the WTO Trade-Related Aspects of Intellectual Property Rights
Agreement, 1995, India is committed to enforcing intellectual property laws. Sec-
tion 11 of the Customs Act, 1962, enables the Central Government to restrict the
import and export of goods that contravene Intellectual Property Rights (IPR). DRI
plays a pivotal role in safeguarding IPR by intercepting counterfeit goods and
items that violate trademarks, copyrights, designs and geographical indications.
